These Terms govern your use of websites, accounts, listings, and advertising or promotional services provided by EscapeKey LLC. By using the services, you agree to these Terms. A separate signed agreement or order controls if it conflicts with these Terms.
Services and listings
EscapeKey provides advertising and promotional services. Unless a written agreement expressly says otherwise, EscapeKey is not a real estate broker, property manager, travel agent, ticket seller, payment processor, or party to a transaction between a visitor and an advertiser. Listings and campaign information are promotional and may change; visitors should independently verify material details before acting.
Accounts
Accounts are issued by EscapeKey and are not open for public registration. You must provide accurate information, protect your credentials, promptly report suspected unauthorized use, and accept responsibility for activity under your account. We may suspend or terminate access to protect the service or enforce these Terms.
Customer content
You retain ownership of content you provide. You grant EscapeKey a nonexclusive, worldwide, royalty-free license to host, reproduce, adapt, display, distribute, and otherwise use that content as reasonably needed to provide, promote, and administer the agreed services. You represent that you have the rights and permissions needed for the content and that it is accurate and lawful.
Acceptable use
You may not misuse the services, interfere with security or operation, scrape or access systems without authorization, submit malicious code or spam, impersonate others, violate intellectual-property or privacy rights, publish deceptive or unlawful content, or use the services in violation of law.
Third-party services
The services may link to or rely on third-party websites, maps, hosting, email, and other providers. EscapeKey does not control third-party services and is not responsible for their content, availability, or practices. Your use of them may be governed by separate terms.
Disclaimers and liability
To the extent permitted by law, the services are provided "as is" and "as available." EscapeKey disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. EscapeKey does not guarantee campaign results, uninterrupted operation, or the accuracy of third-party or customer-supplied content.
To the extent permitted by law, EscapeKey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or lost opportunities. EscapeKey's aggregate liability arising from the services will not exceed the amount paid to EscapeKey for the affected services during the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.
General terms
You agree to indemnify EscapeKey and its personnel from third-party claims arising from your content, misuse of the services, or violation of these Terms, to the extent permitted by law. Florida law governs these Terms without regard to conflict-of-law rules, and disputes will be brought in courts with jurisdiction in Palm Beach County, Florida. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
Changes and contact
